ALCOHOL. All consumers of alcohol must comply with all local and state laws and regulations regarding the sale and consumption of alcohol. Bartender(s) will (a) request proper identification (photo ID) of any person under 30 years of age, and refuse service if the person is either underage or proper identification cannot be produced; and (b) refuse service to any person who, in the Venue’s sole discretion, appears intoxicated or exhibits inappropriate behavior. ATTENDEE BEHAVIOR. All attendees must follow all federal, state and local laws at all times. Fighting, threats or appearances of imminent fights, or other unruly or disruptive behavior is prohibited, including any threatening or hostile behavior (including unwelcome sexual advances, physical contact) towards Venue personnel. If any situation arises involving any form of criminal activity, Venue will contact the police immediately. PETS: Venue reserves the right to restrict any animal of any type (“Pet”) from being brought onto the Premises, excluding registered Service Animals (as defined by 28 C.F.R. § 35.104 and § 36.104 (2010); § 413.08 Fla Stat. (2022). No Service Animals shall be allowed in the Barn unless leashed and maintaining a sterile environment. Venue reserves the right to request that Client identify tasks that a Service Animal is trained to perform (Please keep in mind that animals whose sole function is to provide comfort or emotional support do not qualify as Service Animals). Misrepresenting an animal as a Service Animal is a misdemeanor § 775.082 Fla Stat. (2022). MISCELLANEOUS No glass outside of the building envelope. No smoking within the building envelope. No fireworks or open flame candles. No firearms or other weapons. Only Ever After Farms approved cold sparklers, smoke machine, and/or any other special effect machines are permitted for use on property or within the building envelope Parking is in designated lots only. No harvesting or interference with wildlife or crops.
FLORIDA AGROTiURISM WARNING. Under Florida Law (570.86, Fla. Stat. 2017), Ever After Farms qualifies as an Agritourism Operator. As such, Ever After Farms shall not be liable for injury or death of, or damage or loss to, a participant in an Agritourism Activity, (e.g., the Event) conducted at an Agritourism Location (e.g., the Premises) if such injury, death, damage, or loss results from the inherent risks of the Agritourism Activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss.
